Elon Musk drops the lawsuit against OpenAI

ANDlon Musk has dropped a lawsuit alleging that OpenAI and its CEO Sam Altman violated a founding promise last year by prioritizing profits over humanity.

The billionaire withdrew his complaint a day before a California judge was to hear OpenAI’s resignation. Musk accused the company of becoming a “de facto subsidiary” of Microsoft Corp., violating a founding agreement to be a nonprofit that develops artificial intelligence “for the benefit of humanity.”

OpenAI and Musk are involved in a well publicized battle long before the court case. Musk was an early supporter of the startup and part of its founding team, before falling out with the company.

Musk is now raising money for his own AI company, which he positioned as an alternative to OpenAI. OpenAI argued that Musk would use pretrial investigation and information sharing, known as discovery in the San Francisco case, to gain access to his “proprietary records and technology.”

OpenAI also claimed that Musk in 2017 supported the company’s plans to become a for-profit company and insisted that it raise “billions.” OpenAI has denied that it ever had a founding agreement to violate or that it promised to make its technology open source, as Musk has claimed.

On Monday, Musk said he would ban his companies’ Apple Inc. devices if OpenAI’s artificial intelligence software was integrated at the operating system level, calling the partnership a security risk.

Representatives for Musk and OpenAI did not immediately respond to requests for comment.
