Manhattan court hearing scheduled ahead of Harvey Weinstein retrial in New York

NEW YORK — NEW YORK (AP) — HarveyWeinstein is scheduled to appear in a New York courtroom ahead of his scheduled retrial on rape and sexual assault charges.

The disgraced Hollywood mogul is attending a pretrial hearing in Manhattan criminal court on Tuesday. His retrial is tentatively scheduled for sometime after Labor Day.

Weinstein’s lawyer, Arthur Aidala, and spokesmen for Manhattan District Attorney Alvin Bragg declined to comment on what will be discussed at the hearing.

During the last hearing in May, prosecutors told Judge Curtis Farber that they are evaluating more allegations of sexual misconduct made against Weinstein and that they could seek new charges against him.

Assistant District Attorney Nicole Blumberg said more people had filed assault complaints and prosecutors were evaluating which ones fall within the statute of limitations.

She said some potential survivors who weren’t ready to step forward during Weinstein’s first trial in New York may now be willing to testify.

Aidala said he was confident that no additional accusers would be found to bolster the prosecution’s case.

Weinstein, 72, said any sexual activity was consensual. He is currently in custody at the Rikers Island prison complex, but has suffered from medical issues during his time behind bars.

In April, New York’s highest court rejected Weinstein’s rape conviction following a trial judge’s ruling unfairly allowed testimony against him based on allegations from other women who were not part of the case.

O decision reopened a painful chapter in America’s reckoning with sexual misconduct by powerful figures. O #MeToo era began in 2017 with a barrage of accusations against Weinstein.

Weinstein, who was serving a 23-year sentence in New York, was also convicted in Los Angeles in 2022 of another rape and is still sentenced to 16 years in prison in California. But in a appeal filed last month in California’s Second District Court of Appeal, Weinstein’s lawyers argued that he did not get a fair trial in Los Angeles.
