Vanderpump Rules’ Ariana Madix and Katie Maloney Raise $1.8 Million in Something About Her Product Sales as Lawsuit Drags On

ARIANA Madix and Katie Maloney’s merchandise sales for their burger joint have been revealed in their legal battle with their former chef.

Ariana, 39, Katie, 37, and Chef Penny Davidi have filed trademarks for Something About Her LLC, and now, the Vanderpump Rules the stars are opposing Penny’s request – almost a year after they reportedly gave her permission to register the trademark.

According to court documents obtained exclusively by The US Sun, Ariana and Katie have until April 2025 to file discovery in their trademark dispute against Chef Penny Davidi.

After that, they will have all of next year to file pretrial disclosures, rebuttal disclosures, and other briefs.

According to the documents, the deadline for Ariana and Katie to respond is set for January 2026 and a request for an oral hearing, should they decide to go that route, must be made by February 2026.

The Bravolebrities filed an opposition to Penny’s trademark through their company Put A Fork In It LLC on June 25, and also filed a private trademark application on July 9.

In Something About Her LLC’s opposition, filed on July 26, Ariana and Katie criticized Chef Penny – after she previously told The US Sun that she had “proof” that the women gave her permission – and claimed that her request, filed in August 2023, it was “filed without seeking the approval of SAHR (Something About Her) or its administrators and members for the filing of the Application as submitted to the USPTO (United States Patent and Trademark Office).

They then claim, according to documents obtained by The US Sun, that they are “not connected to Opposer (Put A Fork In It LLC) in any way.

The Applicant and the Opponent are entirely separate business entities with no common members, managers or directors.”

Furthermore, they insist that issuing a registration for Penny’s Something About Her trademark “will substantially harm Opposer’s investment and goodwill in the Something About Her brand.”

They also claim that Penny “committed fraud.”

“As a result of Applicant’s willful and materially false statements made in connection with the Application, including in an Affidavit, Applicant has committed fraud against the USPTO, which invalidates the Application,” the documents state.

Ariana and Katie leave out any mention of Chef Penny having been a “partner” in their business and instead brag about how their West Hollywood diner has gained national recognition and how the stars themselves are more famous than Chef Penny “with 2.3 million and 1.7 million followers on Instagram, respectively”.

The company’s owners state: “Since March 2023, products branded and sold under the Something About Her brand have generated sales in excess of $1.8 million.”

Before opening, the store’s website, which “receives an average of more than 150,000 visitors per month,” sold merchandise — and continues to sell merchandise — including previously sold hoodies, t-shirts and socks, and baseball caps, among other things.

The documents note: “Ms. Madix hosts Love Island USA, appeared on the 32nd season of the television dance competition series Dancing with the Stars and played the role of Roxie Hart in the Broadway musical Chicago, a role that Ms. Madix will rerun on August 1, 2024.”

The stars provide a timeline of when Something About Her was an idea brought to light in a January 2022 episode of Vanderpump Rules, which they say had 650,000 viewers.

They then add that they filmed a “soft launch” tasting event for Something About Her, which was filmed in September 2022 but aired in May 2023 and attracted “over 1.4 million viewers.”

The cafe, which opened in May 2024, was “much anticipated and widely publicized in the press”. The women claim their “connects cafe and brand focuses on celebrating femininity and promoting female empowerment and connection.”

Penny’s attorney responded to The US Sun: “The only statement I would make on Penny’s behalf is that she respectfully disagrees with the opposition presented and intends to fully address these issues in the appropriate legal proceedings.”

ANOTHER LEGAL WAR

In addition to the trademark dispute, Chef Penny, Ariana and Katie are involved in a lawsuit in Los Angeles court.

Penny filed a civil lawsuit on July 18, 2024, alleging that the women did not live up to their end of the agreement when she took over as COO/Culinary Director.

As of June 2023, she claims she was promised a 10 percent partnership if she helped develop and operate Something About Her, according to TMZ.

She was supposed to receive $7,5000 a month until January 2024, and then her rate would increase to $10,000 a month.

The parties have a case management conference scheduled for December this year.

Meanwhile, Ariana is still embroiled in a lawsuit with her ex Tom Sandoval after the former couple were sued by Rachel Leviss for revenge porn earlier this year.

And Chef Penny, in turn, is currently helping her 24-year-old daughter, Sophia, fight brain cancer by creating a GoFundMe fundraising to help raise funds.
