VANDERPUMP Rules alum Rachel Leviss will face Ariana Madix and Tom Sandoval in court over her revenge porn lawsuit.
Ariana, 39, and Tom, 41, have tried to have the case dismissed, but will have to dispute Rachel’s claims.
Rachel, 29, has accused her ex-lover Tom and her ex-friend Ariana of revenge porn, spying, invasion of privacy and intentional infliction of emotional distress, according to Deadline.
Judge Daniel Crawley, however, set the trial date for November 3, 2025, although it is subject to change.
Rachel took the Love Island USA host and Tom to court in February.
She was represented by Bryan Freedman, Jason Sunshine and Mark Geragos.
On Thursday, Judge Crawley heard arguments from lawyers on both sides as Ariana and Tom’s respective representatives moved to have the complaint destroyed.
The lawyers cited California’s anti-SLAPP laws relating to free speech.
“Ms. Leviss has placed her entire life, including her sex life, in front of the public,” attorneys on the plaintiff’s team argued regarding the distribution of images showing Rachel masturbating, which is central to the case.
“This court is in a position to readily conclude on the evidence, she violated several criminal statutes and therefore her conduct is not protected activity,” argued an attorney representing Rachel about Ariana allegedly showing the video, which she found on the website of Tom. telephone, to other people before their separation.
“The law suggests that anything beyond the expressly authorized dissemination of pornographic materials constitutes revenge pornography,” he continued.
“The purpose of the act was to threaten her, terrorize her, warn her that Ms. Madix knows about the affair and hates her.”
In addition to seeking damages, Rachel’s legal team requested that all copies of an NSFW Facetime call between her and Tom be destroyed.
They are also seeking an injunction to ensure the video is never seen by anyone again.
LEGAL BATTLE
In May, part of Rachel’s legal case against Ariana and Tom was dismissed.
Judge Crawley rejected Rachel’s aspect of the lawsuit, stating that Tom secretly filmed or saved sexual content of her with the intention of harming her.
Rachel’s lawsuit included an allegation stating that Tom recorded the footage without her knowledge, while Ariana was accused of releasing the footage.
Tom filed an objection to the claim.
He claimed he “only saved private copies of the videos Leviss filmed and shared with him,” according to Court News Service.
