The gardening experts at Toolstation have revealed the gardening laws you need to be aware of so you don’t break.

Although some of these laws can result in a fine of up to £20,000 in extreme cases, a friendly chat with your neighbors can usually solve any problems.

Tree removal and pruning: If you have a tree in your yard that you want to get rid of, it’s best to think twice and do your research.

Gardening experts reveal: “If one neighbor wants to remove or heavily prune a tree that the other neighbor values, disputes can arise over the impact on views, shade or privacy. “

Although it may cause a fight, if it is within the boundaries of your property, the final choice is yours unless you have a Tree Protection Order.

“But some trees may be protected by a Tree Protection Order, which makes it a criminal offense to uproot, fell or destroy them, experts warn.

The maximum fine for breaking this law is £20,000, so double check if you have a TPO.

You can find out by contacting your local council for a map showing this information. Alternatively, you can ask to speak to your local tree officer.

Property Boundaries and Fences: One of the main causes of disagreements between neighbors is arguments over property boundaries and fences.

To avoid this situation, landscaping professionals recommend checking your property’s deed to determine the correct boundaries.

“Most of the time, it’s easy to determine who owns the fence because the fence posts are usually on the homeowners’ side,” they add.

“Additionally, the height of fences or hedges can cause disputes between neighbors if one party feels the height has exceeded the two meter guideline.

“Hedges and fences must be no more than two meters high, and the council may ask you to take them down if a neighbor complains about the height.

“Fortunately, standard fence sizes are less than two meters high, so you shouldn’t have any problems.”

Garden Structures and Additions: A pergola is the perfect addition to a garden if you want a place to relax in the shade.

But if it obstructs your neighbor’s view or violates local building regulations, it could cause a dispute, just like sheds and other garden structures.

“If you’re not sure, talk to your neighbors to let them know what you’re planning and, if there are any problems, contact the council who will be able to give you further guidance,” advise gardening experts.

Hanging branches and plants: “When branches, vines or roots from a neighbor’s tree or plant extend onto the neighboring property, this can lead to disagreements about potential damage to structures, blocked views or the burden of maintenance,” reveal the professionals.

However, it’s important to note that you can only trim overhanging branches to the boundary of your property, otherwise it could be seen as trespassing.

You can climb the tree to carry out the work if necessary, but only on your property and make sure you stay on your side of the fence if you are not allowed into your neighbour’s garden.
