The owner asked for legal advice on a Porsche discussion forum on RennList in 2010.

In the post, the driver said he recently purchased a Porsche 928, a two-door coupe built in the mid-1980s.

The driver had to place the vehicle on jack stands to operate on its belly.

“I’m close, just the damn clutch,” the driver wrote.

But the HOA felt the car lifts were too unsightly for the neighborhood, according to the post.

“I modified my work habits to keep it under control and ensure I respect my neighbors,” he added.

Still, he said they were threatening $300 daily fines for the car.

The driver said the HOA was “requiring me to make it operable, registered and safely inspect it or move it to my garage.”

However, the garage was used by his wife and son.

“This is non-negotiable,” he said.

The owner said he believed some of the HOA’s demand exceeded its legal position.

“I’m not a lawyer, but it seems like the HOA is out of bounds requiring me to register the car,” he suggested.

“This is not specified in the agreements or required by Texas law and that they cannot regulate how often I operate any car I own, even if it is running.”

In the post, the driver specifically asked a lawyer to help him present this argument in court.

Looks like the driver found the right lawyer.

According to an update to the post, the owner of the house said he “won”.

The US Sun was unable to verify whether the owner successfully fought the HOA in court.

Can an HOA prohibit on-street parking?

According to a North Carolina lawyer, an HOA retains the legal right to park anywhere — even in a homeowner’s garage.

The trick, says HOA attorney Mike Hunter, is the deed that homeowners sign when they buy a home within a subdivision.

“If you buy a home in a deed-restricted community, you are required to comply with those restrictions,” he told Charlotte Observant.

“If restrictive covenants say you can’t park on the street, the council has a legal duty to enforce that.”

Many states are passing laws to limit the power of HOAs, although most states still grant HOAs to enforce their regulations, restrictive or otherwise, in any way they see fit.
