AMERICANS could receive a $7,550 payout from BioPlus Specialty Pharmacy Services following the settlement of a class action lawsuit against the company.

BioPlus Specialty Pharmacy recently settled a class action lawsuit alleging the company failed to implement reasonable cybersecurity measures that led to a data breach in 2021, Superior Class Shares reported.

The data breach occurred between October 25, 2021 and November 11, 2021.

The company’s alleged weak security protections led hackers to gain access to customers’ private data, including Social Security numbers.

The specialty pharmacy did not admit wrongdoing but agreed to settle the case by paying an undisclosed sum to any customers affected by the data breach.

Class members may receive monetary compensation based on any expenses related to the data breach or if their Social Security numbers were compromised.

Those whose Social Security numbers have been compromised are eligible to receive a lump sum cash payment of $50 for their trouble.

Any class member whose number was compromised and suffered expenses related to the breach may be compensated up to $7,500, including three hours of lost time reimbursed at $25 per hour.

If a member’s Social Security numbers are not compromised, they can still benefit financially from the lawsuit.

Those without compromised Social Security numbers will not receive the $50 cash payment, but may still be rewarded with reimbursement of up to $750 for expenses related to the data breach.

These members can also claim up to two hours of lost time and receive a $25 per hour reward.

Expenses related to the data breach must be demonstrated through receipts, invoices, account statements, travel documents, police reports or credit reports.

The deadline for deletion and objection is June 18, 2024.

The final approval hearing for the agreement will be on August 22, 2024.

Those who wish complain must do so by July 18, 2024.

Americans affected by a similar data breach settlement could receive up to $5,000.

Lamoille Health Partners, a Vermont-based company, suffered a data breach in August 2022, First-class action reports.

A class action lawsuit accused the company of failing to adequately protect patient data.

Similar to the BioPlus lawsuit, Lamoille’s patients were victims of leaked Social Security numbers and compromised account numbers.

The lawsuit alleges that Lamoille did not do enough to protect his patients.

Lamoille did not admit any wrongdoing, but agreed to a settlement where patients could be compensated up to $5,000 for the violation.

The deadline is June 20th.

What is a class action settlement?

Class action lawsuits offer groups of people, or “classes,” a way to come together in court.

These lawsuits are often filed by one or a few people who allege that a company or other entity has harmed a large group of people.

When a lawsuit becomes a class action, it extends to all “class members,” or people who may have similar claims to those who filed the lawsuit.

Companies often settle class actions – offering payment to class members who typically waive their right to pursue legal action by accepting money.

These payment agreements often include statements from the defendant denying wrongdoing. Companies tend to settle class actions to avoid the costs of further litigation.

Pollution, discrimination or false advertising are some examples of what can lead to a class action lawsuit at a company’s door.
