AMERICANS are in line to receive a payout of up to $5,200 as part of a data breach settlement.

Bosses at life insurer Ethos Technologies have agreed to pay $1 million.

The settlement relates to a data breach that affected customers between August and December 2022, by Superior Class Shares.

The company did not admit any wrongdoing.

Previously, Americans had until December 20, 2023 to file claims, but that deadline has been extended.

Now, the deadline to file complaints is June 5th.

Complaint forms can be submitted electronically or by mail.

Successful applicants will pocket $100 and may receive another payment worth up to $100.

However, the amount may increase or decrease depending on the number of people requesting the money.

Americans can pocket up to $5,000 for out-of-pocket expenses under the terms of the deal.

But there is a set of strict conditions.

Claimants must be able to link the loss to the Ethos data breach.

They must not have received any other payment for the loss and this must have occurred after August 4, 2022.

Applicants must provide proof of a receipt that they did not prepare themselves.

It is not yet known when Americans will receive the check.

A hearing has been scheduled for August 5th.

What is a class action settlement?

Class action lawsuits offer groups of people, or “classes,” a way to come together in court.

These lawsuits are often filed by one or a few people who allege that a company or other entity has harmed a large group of people.

When a lawsuit becomes a class action, it extends to all “class members,” or people who may have similar claims to those who filed the lawsuit.

Companies often settle class actions – offering payment to class members who typically waive their right to pursue legal action by accepting money.

These payment agreements often include statements from the defendant denying wrongdoing. Companies tend to settle class actions to avoid the costs of further litigation.

Pollution, discrimination or false advertising are some examples of what can lead to a class action lawsuit at a company’s door.

Checks will be sent as soon as the terms of the agreement are approved and there is no appeal.

It is too late for Americans to opt out of the agreement.

Meanwhile, thousands of Americans could be in line to receive a share of a $384 million settlement.

More than 190,000 will benefit, according to the Consumer Financial Protection Bureau.

The settlement follows a lawsuit that alleged Think Finance tricked Americans into repaying loans they didn’t owe.

Think Finance was dissolved in 2019 after filing for bankruptcy.

The US Sun also reported how Apple customers will be able to pocket a $349 payment.
