There are just days left before AMERICANS take action to be part of a $9.75 million payment.

This comes after a class action lawsuit was settled with home security company Vivint, which was accused of using customer data to create fake accounts.

In agreeing to a settlement, Vivint did not admit any wrongdoing.

The settlement “does not imply that there was, or would be, any finding that Vivint violated the law,” the court documents state.

O lawsuit alleges that the company violated Fair Credit Reporting Act rules by allegedly accessing consumer credit information without consent and using it to establish fake accounts.

It was further alleged that the company issued collection orders on several of these accounts.

The multimillion-dollar settlement will resolve claims made against the security company by paying compensation to those affected.

Those who have had their credit information accessed by Vivint without authorization, which was then used to open an account, are entitled to benefits.

PAYMENTS

Class members may receive a one-time payment of up to $1,500 under the settlement.

This amount will be paid for each account created with stolen information and subject to a collection process.

Meanwhile, those who did not make collection efforts against the fake account made with unauthorized information may receive a $250 payment.

It is important to note that eligible members can only claim one amount of compensation per account.

The security company also promised to clean up unauthorized accounts and introduce safeguards to prevent misuse.

Under the terms of the agreement, the incident must have occurred between January 1, 2016 and January 16, 2024, for consumers to be eligible.

TAKE ACTION

However, there are only a few days left to request payment.

The deadline to file a complaint is June 7th and can be done here.

Forms can also be emailed or postmarked by June 7th.

The deadlines for exclusion or objection have already expired, as students had until April 15th to do so.

What is a class action settlement?

Class action lawsuits offer groups of people, or “classes,” a way to come together in court.

These lawsuits are often filed by one or a few people who allege that a company or other entity has harmed a large group of people.

When a lawsuit becomes a class action, it extends to all “class members,” or people who may have similar claims to those who filed the lawsuit.

Companies often settle class actions – offering payment to class members who typically waive their right to pursue legal action by accepting money.

These payment agreements often include statements from the defendant denying wrongdoing. Companies tend to settle class actions to avoid the costs of further litigation.

Pollution, discrimination or false advertising are some examples of what can lead to a class action lawsuit at a company’s door.

This means that eligible members who do not self-exclude will lose their legal rights if they do not file a complaint.

If no action is taken, members will not receive compensation and will have waived their right to sue the company for the same claims if they miss the opt-out date.

Meanwhile, GM car owners may be eligible for a portion of a $150 million safety settlement.

Eligible class members can receive up to $1,400 in defective battery recalls.
