Deadline Approaches for $1.25 Million ‘Due Date’ Deal and No Proof of Purchase Required

THE DEADLINE is quickly approaching for eligible Americans to get a one-time payout from a recent settlement.

The $1.25 million award in the deal follows a class action lawsuit filed against Milwaukee Tool.

The plaintiffs in the case accused the toolmaker of selling products with “inaccurate expiration dates,” by Superior Class Shares.

The lawsuit alleges that expiration dates were not improperly assigned to bonded abrasive discs and that Milwaukee Tool did not detail the potential dangers of using the discs after their expiration date.

Milwaukee Tool did not admit any wrongdoing in the case, but agreed to the $1.25 million settlement to resolve the claims and avoid further legal costs.

The company has also agreed to make changes to its packaging with clear statements and date codes for customers in the future.

The note on the packaging also details the potential dangers of using products after their expiration date.

Some Americans may qualify for a one-time direct payment as a result of the settlement agreement if they meet certain criteria.

ELIGIBILITY

Customers who purchased bonded abrasive discs from Milwaukee Tool between January 1, 2017 and April 18, 2024 will be eligible.

They will receive distributions based on the number of purchases they made for the bonded abrasive wheels.

No proof of purchase is required when filing a claim.

Those who have documentation have a chance to earn more money.

FILING A COMPLAINT

Milwaukee Tool customers who believe they are eligible for a rebate can file a complaint form in the settlement website.

The form can also be printed and sent to the settlement administrator.

The deadline to file a complaint is July 2, 2024.

A deadline for deletion or objection is listed for the same date.

What is a class action settlement?

Class action lawsuits offer groups of people, or “classes,” a way to come together in court.

These lawsuits are often filed by one or a few people who allege that a company or other entity has harmed a large group of people.

When a lawsuit becomes a class action, it extends to all “class members,” or people who may have similar claims to those who filed the lawsuit.

Companies often settle class actions – offering payment to class members who typically waive their right to pursue legal action by accepting money.

These payment agreements often include statements from the defendant denying wrongdoing. Companies tend to settle class actions to avoid the costs of further litigation.

Pollution, discrimination or false advertising are some examples of what can lead to a class action lawsuit at a company’s door.

PAYMENT AMOUNT

Without any proof of purchase, eligible customers can claim up to eight units of bonded abrasive discs for $2.50 each.

This means they can get a maximum of $20 out of the deal.

Claimants with proof of purchase can claim an unlimited number of units with a maximum payment of $100.

It’s unclear when distributions will be made to eligible customers, but it’s likely to be near the end of 2024.

A final approval hearing for the agreement is scheduled for August 16, 2024.

Americans should be aware of some other significant agreements with looming deadlines.

Amazon recently agreed to a $3 million pot, with payments of $565 being sent soon to qualified claimants.

A $600 million settlement was also reached in a rail derailment case, with payouts of up to $70,000 sent to some.
