He claims Dollar General denies cash change to shoppers who make cash gas purchases.

Instead, the store puts the change on a Dollar General fuel card that can only be used at its stores, reports Superior Class Shares.

“Given that fuel cards can only be used in Defendants’ locations, Defendants have unjustly enriched themselves to the detriment of Plaintiff and the Class,” the lawsuit says.

“Without any disclosure to their customers, Defendants place the amount of money initially paid by a customer on a fuel card.”

Burns wants to represent all shoppers who bought gas with cash at Dollar General and received their change as a gas card.

The lawsuit alleges that the company is guilty of conversion and unjust enrichment.

He hopes to obtain punitive damages for affected consumers.

LEGAL PROBLEM

In 2023, Dollar General was fined $1 million after being found guilty of overcharging customers.

“This is a win for Ohio consumers,” said Hannah Hundley, spokeswoman for Ohio Attorney General Dave Yost’s office. Insider.

“We are in the process of finalizing how these funds will be distributed to local communities.”

A Dollar General spokesperson said the company was committed to providing customers with “accurate pricing.”

“When a price discrepancy is identified, our store teams are empowered to correct the issue on the spot for our customers,” they said.

Additionally, Wisconsin received $850,000 through a settlement with Dollar General.

A lawsuit revealed that 662 items were priced higher than originally advertised.

These items cost 17% more than the advertised price at checkout.

North Carolina also fined Dollar General $71,000 for its pricing practices from August 2022 to April 2023.

What is a class action settlement?

Class action lawsuits offer groups of people, or “classes,” a way to come together in court.

These lawsuits are often filed by one or a few people who allege that a company or other entity has harmed a large group of people.

When a lawsuit becomes a class action, it extends to all “class members,” or people who may have similar claims to those who filed the lawsuit.

Companies often settle class actions – offering payment to class members who typically waive their right to pursue legal action by accepting money.

These payment agreements often include statements from the defendant denying wrongdoing. Companies tend to settle class actions to avoid the costs of further litigation.

Pollution, discrimination or false advertising are some examples of what can lead to a class action lawsuit at a company’s door.

ROUNDING UP

In June, a customer reported being overcharged at a Dollar General in Mineral Point, Wisconsin, about 54 miles west of Madison.

They noticed a 45-cent charge for Literacy Round-Up, they wrote in the Iowa County Confessions Facebook group.

The customer returned to the store to tell the cashier that he clicked “no” when the keypad asked if he wanted to gather and donate to charity.

“She then asked the manager back there, and I could hear him say, ‘Oh yeah, that’s been happening a lot lately. When you press no, it thinks you pressed yes,’” the buyer wrote.

The customer said the employee and manager said they “didn’t know how this happened” but admitted it happened often.

“I heard her say this has been happening a lot lately and suggested they post something saying, ‘If you’ve been overcharged, please let us know it’s a computer glitch,’” they said.

The customer was refunded, but the damage was done and he said from now on he would always check his receipts.

Dollar General shocked fans by announcing it was reversing its self-checkout policy.
