BNSF Railway Company is a large transportation company with around 37,000 workers.

The railroad company was accused of illegally collecting fingerprints from truck drivers on its automatic gate systems in Illinois, for Superior Class Shares.

The company allegedly did not receive written consent from its employees, provide specific disclosures, or follow biometric privacy regulations.

These errors directly violated the Illinois Biometric Information Privacy Act, or BIPA.

Although BNSF Railway Company did not admit wrongdoing, it agreed to pay $75 million to settle the class action lawsuit.

ELIGIBILITY AND PAYMENTS

To qualify for a payment, class members must meet two criteria.

First, class members must be truck drivers who have registered their fingerprints using an automatic gate system at any of the railroad company’s four facilities in Illinois.

Second, class members must have been fingerprinted between April 4, 2014 and March 5, 2024.

The settlement terms provide that class members may receive an equal amount of the net settlement fund.

The exact amount of the payment depends on how many truck drivers participate in the agreement.

Each student is expected to receive about $1,000.

FILING A COMPLAINT

BNSF Railway Company employees do not need to complete a claim form to receive payment.

However, students must verify their contact information to ensure they will receive their checks.

Truck drivers will automatically receive a check at their last known address, so it is crucial to confirm the accuracy of your details by the July 15, 2024 deadline.

What is a class action settlement?

Class action lawsuits offer groups of people, or “classes,” a way to come together in court.

These lawsuits are often filed by one or a few people who allege that a company or other entity has harmed a large group of people.

When a lawsuit becomes a class action, it extends to all “class members,” or people who may have similar claims to those who filed the lawsuit.

Companies often settle class actions – offering payment to class members who typically waive their right to pursue legal action by accepting money.

These payment agreements often include statements from the defendant denying wrongdoing. Companies tend to settle class actions to avoid the costs of further litigation.

Pollution, discrimination or false advertising are some examples of what can lead to a class action lawsuit at a company’s door.

Employees must also provide their social security number and other tax information, which can be done on the website settlement website.

Settlement administrations will send their checks to truckers within about 60 days of the final approval hearing, which has been scheduled for June 17, 2024.

Americans may qualify for other open class action settlements.

Payments on a $2 million Wahlburgers pickle deal are in dispute and no proof of purchase is required.

Additionally, Macy’s shoppers who purchased an essential room can receive payments from a $10.5 million settlement and no proof is required.
