The plaintiffs told the court they were unaware of the breach “for weeks.”

“This substantial and imminent risk will remain throughout their respective lifetimes,” the lawsuit added.

Carvin said both sides agreed to settle the lawsuit “to avoid the risks, disruptions and uncertainties of continued litigation.”

The 34-page text settlement document said the compensation agreement was reached after “extensive arm’s length negotiation of the agreement.”
