DONALD Trump now has a clearer path to the presidency after his classified documents case was dismissed by a judge on Monday, according to a political expert.

The former president overturned a legal battle obstructing his second bid for the White House, thanks to federal judge Aileen Cannon’s ruling Monday morning.

Federal judge Aileen Cannon ruled that the appointment of special counsel Jack Smith in the case against Trump was a violation of the Constitution.

Trump was accused of illegally taking classified documents to his Florida home.

Federal agents raided his home at the Mar-a-Lago beach club in Palm Beach, Florida to retrieve the classified documents.

He was charged with 40 counts of unlawfully withholding confidential information and obstructing government efforts to obtain the documents.

David Richards, associate professor of international relations and chair of political science at the University of Lynchburg, spoke exclusively to The US Sun about the impact of the decision.

“This decision paves the way for Trump’s presidential campaign,” he argued.

“Even if appealed, the appeal is unlikely to happen quickly. The timing of Cannon’s decision, the day Trump will be nominated at the Republican Party convention, is interesting.”

Cannon, a judge appointed by Trump in 2020, ruled that Smith’s nomination was unconstitutional as the Senate did not confirm his appointment.

“Trump’s investment in nominating judges during his last term appears to have paid off,” Richards added.

The decision is a major victory for the former president, as it eliminates one of the legal challenges facing his campaign.

2024 Republican National Convention

Political consultant and researcher Frank Luntz expressed a similar sentiment about the decision’s impact on Trump’s re-election campaign.

“It really feels like the election gods are smiling on Donald Trump this month,” Luntz exclusively told The US Sun.

The case has no impact on separate cases against Trump, including a state-level election case in Georgia and his conviction in New York earlier this year for his role in paying hush money during his first election.

MURDER ATTEMPTED

As Richards stated, the result comes ahead of his expected nomination by the Republican National Convention as the Republican presidential nominee.

Trump will formally accept the nomination at the RNC and is expected to announce his vice presidential running mate.

Monday marks the first day of the RNC, which will run through July 18 in Milwaukee, Wisconsin, just two days after Trump was attempted to be assassinated at a campaign rally.

Donald Trump’s legal battles

Donald Trump is the first former US president to be convicted of a crime. He was indicted four times in total, and on May 30 he was found guilty in his historic secret trial. He remains the presumptive Republican presidential nominee. The US Sun analyzes the former president’s current legal battles.

New York Business Records

  • Trump was convicted in May of falsifying business records related to $130,000 in secret payments to adult film star Stormy Daniels.
  • The payment, executed by Trump’s former lawyer Michael Cohen, ensured that an embarrassing story would not be published before the 2016 presidential election.
  • Trump now faces up to four years in prison following the guilty verdict.
  • He can only be pardoned by the governor of New York if he is convicted.
  • The trial began on April 15. Trump was found guilty of all 34 charges on May 30.

Classified Federal Documents

  • Trump is accused of mishandling classified documents after leaving office and storing them at his Mar-a-Lago estate.
  • He was also accused of obstructing federal agents as they tried to recover the documents.
  • Trump is also accused of having shown the trove of files to people who were not supposed to see them.
  • Trump faces a range of charges, including allegations that he violated the Espionage Act.
  • Trump is also accused of engaging in a conspiracy to obstruct justice.
  • He faces 100 years in prison if convicted.
  • The case is not expected to go to trial before the November elections.
  • If Trump wins, he could pardon himself or order the Justice Department to drop the charges because the case was brought at the federal level.

Federal Electoral Subversion

  • In August 2023, the Department of Justice charged Trump with the events linked to the January 6 insurrection and the organization of false voter lists.
  • Trump was charged with conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, conspiracy against rights and obstruction of an attempt to obstruct an official proceeding.
  • If convicted, Trump could face a maximum sentence of 55 years in prison.
  • A trial date has not yet been decided, but it is unlikely that the case will go to trial before the November elections.
  • The Supreme Court is considering arguments over whether Trump is immune from prosecution for some or all of his actions while in the White House.

Election interference in Georgia:

  • Trump and 18 others have been accused of trying to change the outcome of the 2020 election in Georgia by pressuring local officials and election workers.
  • The district attorney for Fulton County, Georgia, which includes Atlanta, indicted Trump on racketeering charges in August 2023.
  • He turned himself in at a Georgia prison and had his mugshot taken.
  • A trial is not expected to take place before the November elections.
  • Trump cannot pardon himself if convicted because the charges were brought at the state level.
  • In Georgia, only a board appointed by the governor can approve pardons.

A gunman, identified as Thomas Matthew Crooks, opened fire at Trump’s rally in Pennsylvania on Saturday night.

One victim was shot and killed and two were seriously injured.

A bullet grazed Trump’s ear and he fell to the ground before the Secret Service pulled him off the stage.

Trump released a statement on Truth Social a few hours after the shooting that said, “I was shot by a bullet that pierced the top of my right ear.

“I knew immediately something was wrong as I heard a buzzing sound, gunshots and immediately felt the bullet tearing through the skin.

“There was a lot of bleeding, then I realized what was happening. GOD BLESS AMERICA!”

President Biden released a statement after the shooting condemning the violence and wishing Trump a speedy recovery.

LOOKING AT THE RNC

Republican delegates meet each election cycle for the RNC, where they officially nominate a candidate to represent the party in the presidential election.

A day after the assassination attempt, Trump said The Washington Examiner that he rewrote his convention speech to reflect unity.

“The speech I would give on Thursday would be incredible,” Trump told the publication.

“There was this [assassination attempt] Had it not happened, this would have been one of the most incredible speeches,” he continued.

Trump told the publication that his initial speech was intended to excite his electoral base, but will now shift focus to reiterate the theme of unity between the parties.

“This is an opportunity to bring the whole country together, even the whole world. The speech will be very different, very different from what it would have been two days ago,” she added.

When talking about the assassination attempt, Trump said: “The energy that came from the people who were there at that moment, they just stood there.

“It’s hard to describe what it was like, but I knew the world was watching. I knew history would judge this and I knew I needed to let them know we are okay.”

About 50,000 people are expected to attend the RNC to watch Trump’s speech and see him reveal his running mate.

The US Secret Service has classified the convention as a special national event that will have greater protection than those present at Trump’s campaign rally.
