Rep. Chip Roy (R-Texas) said Friday he plans to introduce a resolution urging Vice President Harris to convene the Cabinet and declare President Biden incapable of performing Oval Office duties following the commander-in-chief’s poor performance. chief in the debate on Thursday.

The announcement marks the latest fallout from the CNN debate between Biden and former President Trump, during which the incumbent stumbled over his words and appeared to lose his train of thought, sparking widespread concern among Democrats.

“I intend to introduce a resolution calling on the @VP to immediately use his powers under section 4 of the 25th Amendment to summon and mobilize key Cabinet officials to declare that the @POTUS is unable to successfully discharge the duties and powers of his office.” , wrote Roy in a post on social platform.

Section 4 of the 25th Amendment — which has never been used — says that if the vice president and a majority of the Cabinet or Congress find the president “unable to discharge the powers and duties of his office,” the vice president shall “immediately assume the powers and duties of the office of Interim President.”

“Whenever the Vice President and a majority of the principal officers of the executive departments or of any other body that Congress may establish by law, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President cannot exercise the powers and duties of his office, the Vice-President will immediately assume the powers and duties of the position of Interim President,” the amendment reads.

Harris defended Biden’s CNN debate performance immediately following Thursday night’s event, admitting it had a “slow start” but arguing it had a “strong finish” and drew a stark contrast between himself and Trump.

“People can debate about questions of style, but ultimately this election and who is president of the United States has to be a question of substance. And the contrast is clear,” Harris told CNN’s Anderson Cooper. “See what happened during the debate. Donald Trump lied repeatedly, as he always wanted to do.”
