Former President Trump on Wednesday praised Supreme Court Justice Samuel Alito for his refusal to recuse himself from upcoming cases related to the 2020 and January 6, 2021 elections, after it was reported that flags linked to the effort “ Stop The Steal” were hoisted outside their homes.

Alito, who was appointed by former President George W. The Supreme Court’s code of ethics says that judges should not make political statements in order to preserve their impartiality in matters that come before the court.

The Supreme Court is expected to rule in the coming weeks on two key cases related to the Jan. 6 attack, including whether Trump has immunity from prosecution.

Trump claims that a president has absolute immunity for official acts while in office and that this immunity applies after leaving office. He and his lawyer have argued that the protections cover his efforts to block the transfer of power after he lost the 2020 election, which is at the center of the criminal charges against him in Washington.

If the Supreme Court agrees with Trump, many of his criminal charges could be overturned. Even if the court doesn’t go that far, its ruling could delay action on several Trump cases beyond the presidential election.
