Schumer: ‘Mistaken’ dismissal of Trump classified documents case ‘must be appealed’

Senate Majority Leader Chuck Schumer (DN.Y.) called Florida Judge Aileen Cannon’s dismissal of criminal charges accusing former President Trump of mishandling confidential documents “incredibly misguided” and called for that his decision be “immediately appealed”.

“This extremely misguided decision flies in the face of long-accepted practice and repetitive judicial precedence,” Schumer said in a statement released shortly after the ruling.

“It is wrong in law and must be appealed immediately. This is further proof that Judge Cannon cannot handle this case impartially and should be reassigned,” he said.

Cannon, a Trump-appointed judge, ruled that the entire criminal case against Trump must be dismissed because the appointment of special counsel Jack Smith violated the Constitution.

She said that after “careful study,” she determined that no legal statute grants an attorney general the authority to appoint a federal official with “the type of prosecutorial power exercised by Special Counsel Smith.”

Trump faced 40 charges stemming from allegations that he had mishandled classified records and obstructed the government’s recovery of those records after leaving the White House.

The decision came the day the Republican National Convention began in Milwaukee.

Sen. Mike Lee (Utah), a conservative Republican on the Judiciary Committee, hailed Cannon’s decision as “good news.”

“Good news for America. Bad news for the legal war and the weaponization of our justice system,” Lee posted on social media site X.
