NEW YORK — Former President Trump on Wednesday targeted potential jurors in his first criminal trial despite a gag order that prohibits him from making public statements about them.
“’They’re Catching Undercover Liberal Activists Lying to the Judge to Get on Trump’s Jury,” Trump posted on Truth Socialgiving credit to Fox News host Jesse Waters.
According to his gag order, the former president is prohibited from “making or ordering others to make public statements about any prospective juror or any juror in this criminal case.”
Prosecutors have already demanded that Trump be fined for three previous posts the former president on Truth Social made in recent days referencing witnesses. The gag order also prohibits Trump from speaking about them regarding their participation in the case.
Trump appealed the gag order, arguing that it is an unconstitutional violation of his First Amendment rights, but it remains in effect as of now.
During the first two days of jury selection, his lawyers attacked potential jurors’ social media posts, claiming many showed anti-Trump bias.
The judge agreed to fire some of them for cause but refused to do so for others, concluding that their positions did not demonstrate that they would be unfair to the former president.
Jury selection continues Thursday, and the judge projected opening statements will take place Monday.
