Progressive Senator Elizabeth Warren (D-Mass.) announced Wednesday that there are currently enough votes in the Senate to lift the filibuster to codify Roe v. Wade. Wade and abortion rights if Democrats gain control of the House and keep the Senate and White House.
“We will lift the obstruction. We have votes for this in Roe v. Wade. Wade,” Warren said on ABC’s “The View.”
She said that if Democrats control the White House and both chambers of Congress in 2025, “the first vote that Democrats will take in the Senate, the first substantive vote, will be to make Roe v. Wade.”
The Massachusetts Democrat said her party would only need “thin” majorities in the House and Senate to overturn the Supreme Court’s 2022 ruling in Dobbs v. Wade. Jackson Women’s Health Organization, which overturned the national right to abortion established by Roe v. .
“Can we make Roe v. Wade is the law of the land if we have it, and I have to be clear, we need to have a majority in the House – a small majority. We can get a very small majority in the Senate, I accept fifty. And a Democrat in the White House. We have these three things: We will lift the filibuster,” she said.
Senate Republicans last week blocked a bill to enshrine Roe v. Wade protections. Wade in law. It failed by 44 to 49 votes, falling well short of the 60 votes needed for bills to pass the Senate under normal order.
President Biden has promised to make Roe v. Wade Wade the “law of the land” in his State of the Union address in March.
“If Americans send me a Congress that supports the right to choose, I promise you: I will restore Roe v. Wade.” Wade as the law of the land again,” Biden said at a joint session of Congress that included Supreme Court justices in the hearing.
