A SUSPECT accused of a racist attack was pictured smiling in his photo after police arrested three people involved.

Gary Miller, 74, was arrested last week after a confrontation with a man collecting petitions in Virginia City, Nevada – about 400 miles north of Las Vegas.

Ricky Johnson, a black man known as UncleRickyd1 on TikTok, shared a video of the confrontation last Friday.

The clip shows Johnson yelling at a white man, later identified as Miller, for allegedly telling him to find the “hanging tree” and then laughing before Johnson was removed from the property.

Johnson tries to get Miller to repeat what he said about “where the hanging tree is.”

“In your backyard,” Miller replied as he clenched his fists.

Miller was charged with violating state crimes of breach of the peace and committing a crime “because of actual or perceived actions.” racecolor, religionnational origin, physical or mental disabilitysexual orientation or gender identity or expression of another person or group of people,” according to the Storey County Sheriff’s Office.

He also faces a misdemeanor charge of noise violation.

Janis Miller, 67, was charged with assault, while Tiffany Miller, 45, was charged with obstructing or delaying a police officer.

All three were released from prison on Wednesday.

The incident happened as cars were marked on the main street for the town’s Hot August Nights event.

The sheriff’s office said it was investigating the incident and the organization Hot August Nights condemned the confrontation on Sunday.

The public outcry was heard loud and clear and steps were taken to hold these individuals accountable for their racist and illegal actions.

Police said they were analyzing all the information provided and spoke to witnesses to find out what led to the incident.

“The public outcry was heard loud and clear, and steps steps were taken to hold these individuals accountable for their racist and illegal actions,” said Nevada Attorney General Aaron Ford in a statement.

Both Ford and Sheriff Mike Cullen said threats were made against law law enforcement and others in the community.

“As we compile all of this information, we will look at each case individually and move forward with separate investigations or not, depending on the circumstances,” Cullen said.

In a TikTokJohnson explained that his initial video has been removed.

“I haven’t gotten an update on anything yet,” Johnson said.

“I’m still waiting for the prosecutor to call me to give me an answer.”

He explained that TikTok removed the video from their page due to “community guidelines.”

“I’ve gotten so many hateful comments and people reporting my page,” Johnson said.

“They had to delete the video, but I’m glad it’s still available everywhere, all over the world.

“To all my supporters, I just wanted to let you know.”

He added that the video was still on his Instagram if people wanted to see it.

US Sun has reached out to the Storey County Sheriff’s Office for comment.
