Are tacos and burritos sandwiches? A judge in Indiana thinks so.

The decision stems from a legal battle that began in 2022, when Martin Quintana, a developer, revealed plans to open his restaurant, “The Famous Taco Mexican Grill,” in a mall in Fort Wayne, Indiana.

O Allen County Planning Commission rejected his offer to open the restaurant, citing a written commitment that Quintana had accepted. Under the agreement with a local condominium association, only non-alcoholic restaurants that did not allow outdoor seating and sold only “made-to-order or subway-style sandwiches” could open there.

The agreement was put in place to prevent some national fast-food chains from opening at the mall, according to court documents obtained by NBC affiliate WPTA.

But after more than two years of legal battles, Judge Craig Bobay of the Allen County Superior Court ruled that Quintana’s original plans would be allowed based on the original compromise.

In his opinion, Bobay ruled that “the famous Taco restaurant is permitted under the terms of the original Written Commitment,” and agreeing with Quintana “that tacos and burritos are Mexican-style sandwiches, and the original Written Commitment does not restrict potential restaurants to only restaurants Americans. culinary style sandwiches.

Bobay said the commission could appeal the decision.
