Family members are mourning the loss of a loved one after he was struck and killed by an impaired driver.

The Concord Police Department says John Stevenson, 35, was struck while walking home on Davidson Highway Friday afternoon. He was just steps away from the back door when he was hit.

Cops say the driver who hit him, 41-year-old David Royce Brown, was arrested and charged with habitual driving while impaired and second-degree murder.

Stevenson’s family told veteran crime reporter Glenn Counts that he had just gotten off work and was heading home when the incident happened. They believe Brown should not be on the street, given his history.

“It’s a flawed system, which is why my brother is no longer here,” said Damon Brooks, Stevenson’s brother. “How can you walk on the side of the road at 1:27 pm in the middle of the day and get hit by a drunk driver?”

In North Carolina, the law says a person must have three DWI convictions in the last 10 years to receive the charge.
