A woman has filed a lawsuit against Walt Disney Parks, claiming she suffered a brain injury after becoming unconscious and left “lame” and bleeding after riding a waterslide at Typhoon Lagoon in Florida.
The lawsuit, filed Monday in an Orange County, Florida, circuit court, alleges that Disney failed to provide a safe environment and warned that there were no lifeguards at the end of the ride.
NBC News did not verify whether the park posted signs or warnings about lifeguards during the ride.
The lawsuit states that after the woman’s mother and fiancé discovered she was limping, they asked dispatchers for help. The attendants told the pair that they were not lifeguards and that they would need to find lifeguards.
“If Defendant had had lifeguards at the end of the ride to watch over and assist guests exiting the ride, Plaintiff’s brain injury would not have occurred as she would not have been drowning in the water and coughing up blood,” the lawsuit says.
Disney did not respond to a request for comment.
The 25-year-old Orange County woman is undergoing neurological treatment following the traumatic experience, said her attorney, Richard Russo.
“Her mother said she heard her head hit the slide because her mother was also on the slide,” Russo said. “Her fiancé and her mother were frantically asking for a lifeguard, and there were no lifeguards around.”
The lawsuit seeks an amount in excess of $50,000 in damages.
The Humunga Kowabunga ride is the steepest waterslide at Disney’s Typhoon Lagoon and sends guests down a five-story drop at nearly 40 mph, according to the park website.
In October, another woman filed a lawsuit involving the same trip, alleging the trip caused a “dangerous injury” that left her with severe vaginal lacerations and damage to internal organs.
Disney has not commented on this lawsuit.
