Man shot by police now in prison; 2 Xenia officers on leave

July 3—A 23-year-old man shot and injured by Xenia police officers on Sunday was booked into the Greene County Jail Tuesday night following his release from Miami Valley Hospital.

Bail was set at $500,000 for Kyle Eugene Berry during his arraignment Wednesday in Xenia Municipal Court on two counts of felonious assault, online court records show.

Two Xenia police officers are on administrative leave as part of a “routine procedure” related to an officer-involved shooting on Sunday. The police shooting was the second in 24 hours in the Dayton area.

Around 7:25 a.m. Sunday, police were called to an apartment complex in the 100 block of South Orange Street in Xenia, just south of where Bellbrook Avenue ends at West Second Street.

The 911 caller indicated that a man was shooting at the apartment complex. The manager of the Greene Manor Apartments complex told police the individual also pointed a gun at him, according to the initial police report.

Six Xenia police officers responded, as did several deputies from the Greene County Sheriff’s Office. Officers saw the man point a gun at police and opened fire, according to the Xenia Police Division.

The person shot, identified as Berry, could face additional charges once the case is presented to the county grand jury, police said.

The Ohio Department of Criminal Investigation was asked to conduct the criminal investigation.

The two officers involved in the shooting were placed on leave as a “routine” part of an officer-involved shooting, according to Xenia police. They were not identified. One has 16 years of law enforcement experience and the other has 10 years of law enforcement experience.

“The Xenia Division of Police will continue to cooperate with BCI and the Greene County Prosecutor’s Office as they conduct their investigation,” police said.
