Elon Musk has agreed to testify in the Securities and Exchange Commission’s investigation into Twitter’s $44 billion acquisition. A legal document presented on Thursday shows that Musk waived his right to appeal a court order this requires him to testify.
This means that Musk will have to appear at one of the SEC offices for an interview lasting up to five hours. The document says that Musk and the SEC have already agreed on a date, but it has not been disclosed “for confidentiality purposes.”
In 2022, the SEC opened an investigation into Musk’s failure to adequately disclose his Twitter holdings. But the SEC filed a case against Musk last October after he refused to testify in the agency’s investigation. The SEC claims that Musk “abruptly notified SEC staff that he would not appear” two days before his scheduled deposition and refused to testify afterwards. Earlier this year, the SEC accused Musk of trying to delay the investigation.
Musk has clashed with the SEC several times in the past, accusing the agency of “relentless” harassment and stifling his free speech.
